Abstract :

Abstract The subject of specification represents one of the methods of the diligence by the service by the suggestion, and it had formed a natural extension of the natural relation between mind and the Sharia and it is the continuity not the dissimilation and the integration agreement and the mutual alienation. I have spread out for this subject by discussing the relation between human mind and the Sharia and that human mind is in need of the guidance inspiration and that the authority of a judgment putting is only the Sharia the field of mind than the application . Then I have explained afterwards human mind and its role in the legislation and its application, and that a field of the diligence what is not mentioned by a text or mentioned in a boubted text , but truly the stumps of the judgments then not working hard for it but resort in its application . I have explained that the specification is the most important kind of the interpretation and the interpretation by which is the specification by the service what resorts a picture for the diligence in what are the general text and its aim. Then I have investigated the care of the service in the Sharia copanionsescorted the prayer on him and the peace , and andprophet that the summary of the service : " use or avoiding evils in consideration of the legistlator " in other words , it doesn't torment the suitable for the aims of thelegistlators, and that it is not a strange service or illusory , and I have explained that the essence of the service by which is distinguished is a subject of the study is after the realization of the sent service which the legistlator doesn't attest its consideraton or annulment by a specific sign but it is suitable for the destinations of the legistlator " , and the root savants state as it is co
